You can complain to the High Court Enforcement Officers’ Association if you’re dealing with high court enforcement officers. Bailiffs have to say if they’re high court enforcement officers – it will be on any letters they’ve sent you, and on the ID they have to show you if they visit you.

The bailiff company cannot make a profit from your enforcement case. You can pay using a CREDIT card, so you can execute a chargeback to quickly and efficiently get your money or vehicle back, or pay with a DEBIT card and persuade the bank to reverse the transaction later.

Do bailiffs lie?

Bailiffs are not allowed to use threatening behaviour or lie to gain access to your property. You should be given at least seven days’ notice that a bailiff is visiting you. This gives you a chance to settle the debt beforehand.

For most kinds of debt, bailiffs are not allowed to enter your property if no-one is in. They are also not allowed to enter your house if the only people there are under 16 or vulnerable (for example, due to disability).

What to do if you have a complaint about a bailiff?

If you have a very serious complaint about a bailiff (enforcement agent), then there is a procedure whereby you may complain to the County Court that granted the bailiff his certificate. Such a complaint is referred to as an EAC2 compliant (previously called a Form 4 complaint) and should only ever be a last resort.
