Your bankruptcy case is not over when you get a discharge, but when the court closes it with a final decree or order. Most debtors file for bankruptcy relief to discharge (wipe out) their debts.
What happens to your debt after you file bankruptcy?
The bankruptcy discharge eliminates your obligations to pay debts included in your bankruptcy filing. If you listed it and you received a discharge, then you are no longer responsible or liable for that debt.
Can a debt collector collect on a bankruptcy discharge?
If a creditor or debt collector contacts you after your bankruptcy discharge to collect on a discharged debt, it is a serious violation of the Bankruptcy Code.
Can a Bankruptcy Court revoke a discharge order?
In chapter 11, 12, and 13 cases, if confirmation of a plan or the discharge is obtained through fraud, the court can revoke the order of confirmation or discharge. May the debtor pay a discharged debt after the bankruptcy case has been concluded? A debtor who has received a discharge may voluntarily repay any discharged debt.
How can I find out if my bankruptcy case has been discharged?
Contact your attorney; she’ll know if your case has been discharged yet or not. You can also ask her for a copy of your bankruptcy discharge notice. She should have the notice in her files and should be able to fax, email or regular mail the notice to you. Attorneys usually provide this service to their clients at no charge or for a small fee.
Can a bankrupt go to a discharge hearing?
As the bankrupt is usually aware of the circumstances as to why the discharge hearing is called, it is their decision as to whether they will obtain legal representation for the discharge hearing. If you file bankruptcy a third time, you cannot receive an automatic discharge and are required to attend a court hearing.
