A wage garnishment is one tool that creditors use to collect debts….Those are:
- collectors of federally-guaranteed student loans.
- people and agencies to whom you owe child support or alimony, and.
- taxing agencies to whom you owe back taxes (like the IRS or state taxing authority).

Under the American Rescue Plan, which authorized the latest round of stimulus checks, payments are protected from all offset. That means you’ll get the full amount you qualify for even if you have past-due federal or state debt, such as child support, or you owe taxes from previous years.

While many states have also put in provisions to protect stimulus checks from debt collection, we’ll be focusing on wage garnishment protections here. Per federal law, 75% of your disposable earnings or 30 times the federal minimum wage, whichever is greater, is exempt from wage garnishment for ordinary garnishments, which includes consumer debt.
How much can a creditor garnish in Washington DC?
Wage garnishment in D.C. is limited by Statute 15 U.S.C. §1673 and D.C. Statute Section 16-572 which states the most a creditor can garnish from wages is 25% of exempt earnings or 30 times federal minimum wage. The statute also states that D.C. Government employees are exempt from having their wages attached.
Do you need to contact your state for wage garnishment?
Please contact your state for the most recent changes to the law. The wage garnishment law specifies that the garnishment restrictions do not apply to certain bankruptcy court orders, or to debts due for federal or state taxes. If a state wage garnishment law differs from the CCPA, the law resulting in the smaller garnishment must be observed.
