Is overdrafting your bank account a crime?

Writer Mia Lopez

Overdrawing your bank account is rarely a criminal offense. According to the National Check Fraud Center, all states can impose jail time for overdrawing your account, but the reasons for overdrawing an account must support criminal prosecution.

What is the Overdraft Protection Act?

The Overdraft Protection Act of 2021 would: require that fees be “reasonable and proportional” to the cost of processing these transactions and the amount of the overdraft; prohibit charging overdraft fees for “debit holds” that exceed actual transaction amounts, among other strong measures.

What happens if I keep overdrafting my account?

Overdrawing too often (or keeping your balance negative for too long) can have its own consequences. Your bank can close your account and report you to a debit bureau, which may make it hard for you to get approved for an account in the future. (And you’ll still owe the bank your negative balance.)

Can my overdraft be taken away?

You may receive an overdraft automatically with a new current account, or you may have to request one. You’ll be charged interest while you’re using the overdraft, but there won’t be any further charges to pay. An overdraft is a form of credit that can be taken away at any time, without notice, by your bank.

What is the overdraft protection law and when was it enacted?

Introduced in House (03/19/2013) Overdraft Protection Act of 2013 – Amends the Truth in Lending Act to prohibit a depository institution from engaging in unfair or deceptive acts or practices in connection with overdraft coverage, or in acts designed to evade the provisions of this Act.

How long can you stay in your overdraft?

Overdrafts are available for as long as the bank authorises them, and for as long as you pay the fees and charges that they incur.

What to do if your checking account is overdrafted?

Bank apps make it convenient to keep tabs on your balance, and many banks offer notifications such as text reminders when your balance is low. If you do get hit with an overdraft or returned check fee, and it is the first time, it is worth calling your bank to ask to have it waived.

Can you go to jail for overdrafting your bank account?

Even if you’re not criminally charged with fraud, you can still be incarcerated in some states if the bank gets a judgment against you in civil court. If the judge orders you to make payments to satisfy the debt and you ignore the court’s order, this is contempt of court and can result in jail time.

What happens if you don’t take care of an overdraft?

If you do not take care of your overdraft, even if the account is closed, your bank will likely report this to ChexSystems, and this could make it more difficult for you to open another account at a different bank. Similar to a negative entry on your credit report, negative ChexSystems reporting lets financial institutions assess your risk.

Can a bank automatically enroll you in overdraft protection?

Federal regulations require bank customers to opt in to overdraft protection programs . That means that your bank cannot automatically enroll you when you open an account. While these programs may seem like a safety net, they can result in an avalanche of fees. 1
