How often can debt collectors contact you?

Writer John Parsons

Federal law doesn’t give a specific limit on the number of calls a debt collector can place to you. A debt collector may not call you repeatedly or continuously intending to annoy, abuse, or harass you or others who share the number. You do have a right to tell the debt collector to stop calling you.

Can a debt collector leave a message?

Under the Fair Debt Collection Practices Act, debt collectors are required to identify themselves in any communication with a debtor. The bottom line is, under the FDCPA, debt collectors should not leave answering machine or voicemail messages.

Why Do collection agencies not leave messages?

Because debt collectors are not permitted to contact anyone other than you or your spouse, most often a debt collector is not allowed to leave voicemails at work. This is because typically a work phone will be accessed by other employees or your boss.

When does a debt collector have to contact you?

Most notably, they cannot state that you owe any debt and may only identify their employer when asked. There are also legal restrictions on when and where a debt collector may contact you. Usually, any time before 8:00 a.m. or after 9:00 p.m. is off-limits.

Is there Statute of limitations on calling a debt collector?

Unlike the credit reporting time limit, making an account can restart the statute of limitations on an old debt, giving the collector more time to sue. This is only partially true. Verbally telling the debt collector to stop calling you only works in two instances.

How long do debt collectors stay on your credit report?

If you try to get an account with that business again, you’ll have to clear up the unpaid debt first. Accurately reported debt collections can remain on your credit report for up to seven years. A cease and desist letter stops debt collectors from calling you.

What happens when you ignore a debt collector?

It’s a good idea to request debt validation before you pay any debt collection. If ignoring debts made them go away, none of us would ever pay up. Debt collection calls and letters may stop if you ignore a debt long enough, but the debt doesn’t go away. It will continue to be listed on your credit report until the credit reporting time limit is up.
