Writer Robert Bradley

You can remove your eviction from your public record by petitioning the court, winning your case or disputing an inaccurately reported eviction. While the process is more difficult, it’s not impossible.

Does eviction go on your credit report?

The eviction itself won’t show up on your credit reports. However, a landlord may choose to seek payment by selling your debt to a collection agency. If your unpaid debt goes to collection, it can remain on your credit report for seven years and may negatively impact your credit score.

How long does an eviction stay on your credit report?

Unfortunately, no. Public records such as bankruptcies, tax liens and civil court judgments, like evictions, stay on your credit report for seven years from the filing date and will do some serious damage to your credit score.

Can a landlord remove an eviction from your credit?

Your landlord can sign an agreement which states that they plan to remove the eviction from your credit history once you’ve paid them. That document can be used to show that you’ve made good on you past debt, even if it takes a bit longer to have it removed from your record.

When does a landlord not have the right to evict?

The landlord cannot file for an eviction because they get into a disagreement with the tenant or because the tenant has filed a health or safety complaint with the town. Here are four times the landlord does not have the legal right to evict a tenant.

What happens if I file a response to an eviction?

You’ll receive a copy of the action and, if you file a response, you’ll be given a trial date. At trial, the landlord must prove the case against you. If successful, the landlord will obtain a ruling from the judge that allows the landlord to evict you, often known as an eviction judgment or a judgment of possession.
