In California (and most states) a defendant has a specified period of time to file an answer or other appearance in Court after being served by a plaintiff and failure to respond within that time period allows the plaintiff to enter a default and eventually obtain a judgment predicated on default.

Who enters a default judgment?

(a) Entering a Default. When a party against whom a judgment for affirmative relief is sought has failed to plead or otherwise defend, and that failure is shown by affidavit or otherwise, the clerk must enter the party’s default.
